By creating a SAWYD account, you agree to use the platform for private future messages and related legacy tools. Please read these Terms carefully before using SAWYD. If you do not agree, you must not use the platform.

About SAWYD

Who We Are

SAWYD ("Stay Alive When You Die") is a private digital legacy platform operated by Nebojša Aleksić, Belgrade, Serbia. SAWYD allows users to create personal messages and choose delivery to selected recipients on a specific date, at a life moment, or after trusted confirmation. Section 2

The SAWYD Service

What We Do

SAWYD is a service provider. By using the platform, you authorize SAWYD to store, process, and deliver your messages according to the settings you choose. This authorization is limited to the content, recipients, trusted contacts, and delivery instructions you provide inside the platform.

What We Are Not

SAWYD is not a law firm, estate planner, trustee, executor, or general legal representative. Nothing in these Terms creates a power of attorney, will, trust, or formal estate-planning document.

SAWYD ID

When you create an account, SAWYD may assign you a unique SAWYD ID. Your SAWYD ID is a service-based identifier connected to your account and used to organise your messages, trusted contacts, and related legacy tools. A SAWYD ID does not create a property right, financial asset, token, legal identity, estate document, or transferable ownership interest. You may not sell, transfer, assign, licence, or trade your SAWYD ID without SAWYD's written approval.

Section 3

Eligibility & Acceptable Use

Eligibility

You must be at least 18 years old to use SAWYD. By creating an account, you confirm that you are 18 or older. You must provide accurate and complete registration information and maintain the security of your account credentials.

Acceptable Use

You agree not to use SAWYD to send threatening, harassing, abusive, unlawful, misleading, spam, commercial, or impersonation-based messages. You also agree not to falsely trigger trusted-contact delivery or interfere with the platform's security or operation. Violation of these terms may result in account termination.

Section 4

Trusted-Contact Verification

Notification Phase

If SAWYD detects account inactivity for six (6) consecutive months, we will send check-in notifications for a further three (3) months before initiating the verification process.

Verification Phase

If you remain unresponsive, SAWYD will contact your designated trusted contacts. A minimum of two (2) independent confirmations are required before any messages connected to trusted confirmation may be delivered. This requirement helps protect against accidental or premature activation.

User Responsibility

You are solely responsible for ensuring your trusted contacts are informed of their role and that their contact information is kept current. Trusted contacts are expected to act honestly and in good faith. Misuse of the verification process may result in account restrictions or other appropriate action.

Section 5

Your Content & Ownership

Your Content is Yours

You retain full ownership of all messages and content you create on SAWYD. We do not claim any rights over your personal messages. By using SAWYD, you grant us a limited, non-exclusive licence to store, process, and deliver your content solely for the purpose of providing the service. We do not sell or commercially exploit your personal messages. We do not access message content except as needed to provide the service, troubleshoot, comply with law, or protect the platform and users.

Future Features

SAWYD may introduce additional features in the future, such as expanded storage, export tools, or other legacy-related tools. Any feature that involves new data use, sharing, or third-party access will require a separate and explicit opt-in agreement.

Section 6

Future Legacy Tools

Planned Development

SAWYD may develop additional legacy tools over time. These may include expanded message storage, file storage, export options, or tools that help users organise selected memories, files, wishes, and digital footprint information. Future tools may have separate terms, pricing, and consent requirements.

Section 7

Privacy & Data Rights

Privacy Policy

SAWYD handles personal information according to its Privacy Policy. Depending on your location, you may have rights to access, correct, delete, or request a copy of your personal data. You can contact hello@sawyd.com for privacy-related requests.

Section 8

Service Changes and Continuity

Our Commitment

SAWYD is being built with long-term care in mind, but we cannot guarantee that the service will operate indefinitely. If we make major changes, discontinue features, or shut down the service, we will make reasonable efforts to notify users and provide available export or download options where technically and legally possible.

Service Availability and External Dependencies

SAWYD is built with long-term care in mind, but we cannot guarantee that the service, the internet, cloud providers, email systems, storage providers, third-party infrastructure, or any external technology will remain available indefinitely. SAWYD is not responsible for failures, outages, legal restrictions, force majeure events, infrastructure changes, or third-party provider issues outside our reasonable control.

Section 9

Message Delivery

Best Efforts

SAWYD will make all reasonable efforts to deliver your messages on the date or under the conditions you have specified. However, we cannot guarantee delivery in cases of incorrect or outdated recipient email addresses, service outages, technical failures, force majeure events, or failure of trusted contacts to complete the confirmation process within a reasonable timeframe.

Your Responsibility

You are responsible for keeping recipient contact information accurate and up to date. SAWYD is not liable for any emotional, financial, or legal consequences arising from the non-delivery, delayed delivery, or unintended delivery of messages.

Section 10

Intellectual Property

Our IP

All aspects of SAWYD — including its name, logo, design, code, features, and brand identity — are the intellectual property of SAWYD. You may not copy, reproduce, distribute, or create derivative works from any part of SAWYD without our express written permission. The SAWYD™ name and "Stay Alive When You Die™" tagline are trademarks of the operator. Unauthorised use is strictly prohibited.

Section 11

Disclaimer of Warranties

As Is

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE. YOU USE SAWYD ENTIRELY AT YOUR OWN RISK.

Section 12

Limitation of Liability

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAWYD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, EMOTIONAL DISTRESS, OR FAILURE TO DELIVER A MESSAGE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM. If you use SAWYD for free, any liability will be limited to the maximum extent permitted by applicable law.

Section 13

Indemnification

Your Responsibility

You agree to indemnify, defend, and hold harmless SAWYD and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: (a) your use of SAWYD; (b) your violation of these Terms; (c) the content of your messages; or (d) your violation of any third-party rights.

Section 14

Governing Law

Jurisdiction

These Terms are governed by the laws of the Republic of Serbia, except where mandatory consumer protection or privacy laws in your jurisdiction apply. Any disputes should first be addressed through informal negotiation. If unresolved, disputes may be handled by the competent courts or agreed dispute-resolution process in Serbia, unless mandatory law provides otherwise.

Changes to These Terms

Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by email. Your continued use of SAWYD after changes take effect constitutes your acceptance of the revised Terms. The current version is always dated at the top of this page.
